Welcome to Fairway Legends Performance.

Our Studio Memberships are designed to provide exceptional value, flexible access to our premium indoor golf facilities and an enjoyable experience for golfers of all abilities.

These Terms & Conditions govern Studio Memberships, including Unlimited Lite, Unlimited Ultra, Par Studio and any other membership expressly offered as a Studio Membership.

These Terms & Conditions do not apply to Academy Memberships, which are governed by separate Academy Terms & Conditions.

By purchasing a Studio Membership, you agree to the following terms, subject to your statutory consumer rights.

1. Membership Agreement

1.1. Membership provides access to the benefits associated with the selected Studio Membership tier, subject to availability and these Terms & Conditions.

1.2. Membership benefits are personal to the named member and cannot be transferred, sold or shared with another individual.

1.3. Members may bring permitted guests in accordance with Section 7.

1.4. Membership benefits remain available while the membership is active and payments are up to date, subject to applicable consumer rights.

1.5. Membership access hours, booking allowances, included credits, fees and other benefits will be confirmed before purchase.

1.6. Fairway Legends Performance may reasonably verify membership identity to prevent unauthorised use.

2. Membership Term

2.1. All Studio Memberships operate on an initial minimum commitment of 12 months, unless a different term is expressly stated at the time of purchase.

2.2. Following the initial 12-month commitment, membership continues automatically on a monthly rolling basis until cancelled in accordance with Section 3.

2.3. The minimum commitment, monthly fee, renewal arrangements and cancellation requirements will be clearly disclosed before purchase.

2.4. Members remain responsible for membership fees due under their agreement, subject to applicable consumer law and any right to terminate early.

3. Studio Membership Cancellation Policy

3.1. Members must provide a minimum of three (3) calendar months’ written notice to cancel their Studio Membership.

3.2. Cancellation notice may be submitted at any time, including during the initial 12-month commitment.

3.3. Ordinary cancellation will not take effect before the end of the initial minimum commitment period.

3.4. Following the initial 12-month commitment, memberships continue on a monthly rolling basis until the applicable three-month notice period expires.

3.5. The notice period begins on the date Fairway Legends Performance receives the written cancellation request.

3.6. Membership fees remain payable throughout the applicable notice period, and members retain their membership benefits during that period, provided payments remain up to date.

3.7. Fairway Legends Performance will acknowledge cancellation requests in writing and confirm the final membership date.

3.8. Cancellation requests must be sent to:

3.9. No additional cancellation administration fee will be charged.

3.10. Nothing in this section restricts statutory cancellation or termination rights, including rights arising from a material failure to provide the agreed services.

3.11. This three-month cancellation notice applies exclusively to Studio Memberships. It does not apply to Academy Memberships.

4. Membership Payments

4.1. Membership fees are collected monthly on the 1st day of each calendar month, unless a different arrangement is confirmed at purchase.

4.2. Members must maintain a valid payment method and ensure payments can be collected.

4.3. Where a payment fails, Fairway Legends Performance will notify the member and provide a reasonable opportunity to resolve the outstanding amount.

4.4. Continued non-payment may result in temporary suspension of membership benefits, including:

• Studio booking access.
• Membership booking credits.
• Member discounts.
• Advance booking privileges.
• Exclusive membership offers.

4.5. Benefits will be reinstated when outstanding payments are resolved, provided the membership remains active.

4.6. Continued non-payment may result in termination following appropriate notice.

4.7. Any outstanding fees will remain payable to the extent lawfully recoverable.

5. Studio Booking Privileges

5.1. Members may book eligible studio sessions up to four weeks in advance.

5.2. All bookings are subject to availability and the access hours associated with the selected membership.

5.3. Membership does not guarantee exclusive access to any simulator bay, time slot or facility.

5.4. Unlimited Membership holders may hold a maximum of two active future studio bookings at any one time.

5.5. Unlimited Membership holders may make one advance studio booking per day. Additional same-day sessions may be booked where availability permits.

5.6. There is no fixed membership-wide two-hour session limit. Members must select from the available booking durations offered by the booking system and comply with their confirmed booking times.

5.7. Credit-based memberships may make bookings in accordance with their available credit balance and the booking system’s permitted session durations.

5.8. All bookings must be made through the official Fairway Legends Performance booking system.

5.9. Membership bookings cannot be sold, transferred or exchanged.

5.10. Reasonable booking controls may be applied to prevent misuse and maintain fair availability.

6. Booking Changes, Cancellations & No-Shows

6.1. Members may cancel or reschedule bookings more than 48 hours before the scheduled start time without penalty.

6.2. For credit-based memberships, bookings cancelled within 48 hours of the scheduled start time will ordinarily be treated as used, and the corresponding credits will not be returned.

6.3. For Unlimited Memberships, repeated late cancellations and no-shows may result in proportionate restrictions under the Fair Use Policy.

6.4. Members must cancel bookings they no longer intend to attend, even where the cancellation deadline has passed.

6.5. Fairway Legends Performance may exercise reasonable discretion in exceptional circumstances, including illness or emergencies.

6.6. Where Fairway Legends Performance cancels a confirmed booking, affected credits will be restored or an appropriate replacement, refund or other legally required remedy will be offered.

7. Guests

7.1. Studio Members may bring up to three guests per booking, subject to studio capacity and the guest arrangements applicable to their membership tier.

7.2. The named member must be present throughout the booking.

7.3. Guests do not receive independent membership rights.

7.4. Any additional guest charges must be communicated before the booking is confirmed.

7.5. Members must ensure their guests follow studio rules and reasonable safety instructions.

7.6. Members may be held responsible for loss or damage caused by guests where legally appropriate.

7.7. Guest privileges must not be used for commercial coaching, resale of simulator time or other unauthorised business activities.

8. Member Responsibilities & Studio Rules

All members and guests must:

• Treat staff, other members and facilities respectfully.
• Follow reasonable instructions from Fairway Legends Performance staff.
• Ensure golf clubs are clean before entering simulator bays.
• Use only golf balls supplied or expressly approved by Fairway Legends Performance.
• Wear suitable clothing and footwear.
• Use equipment safely and for its intended purpose.
• Respect their allocated booking times.
• Leave facilities clean and tidy.
• Report equipment faults, damage or safety concerns promptly.
• Appropriately supervise children attending under their booking.

Abusive, threatening, dangerous or disruptive behaviour is not permitted.

Fairway Legends Performance may refuse access or require an individual to leave where reasonably necessary for safety or to protect others.

9. Damage to Equipment & Facilities

9.1. Members and guests must take reasonable care when using the facilities.

9.2. Members may be responsible for damage caused by their own negligence, deliberate misuse or failure to follow reasonable studio rules.

This includes damage to:

• TrackMan launch monitors.
• Simulator screens.
• Projectors and technical equipment.
• Zen Green putting equipment.
• Furniture and fixtures.
• Retail displays.
• Other Fairway Legends Performance property.

9.3. Fairway Legends Performance may seek recovery of reasonable repair or replacement costs where legally justified.

9.4. Normal wear and tear will not be charged to members.

9.5. Any damage claim will be assessed fairly based on the circumstances and available evidence.

10. Membership Benefits

10.1. Membership benefits vary according to the selected membership tier.

10.2. Benefits may include:

• Unlimited eligible studio access.
• Monthly studio booking credits.
• Member-only discounts.
• Advance booking privileges.
• Exclusive events or promotions.
• Other benefits expressly included at purchase.

10.3. Membership benefits are personal, non-transferable and cannot be exchanged for cash.

10.4. Benefits cannot normally be combined with other promotions unless expressly permitted.

10.5. Material reductions to agreed membership benefits will not be made without appropriate notice and respect for members’ contractual and statutory rights.

11. Membership Fair Use Policy

Fairway Legends Performance memberships are intended for genuine personal recreational use.

The Fair Use Policy ensures that members can enjoy regular access while maintaining reasonable availability for other members and customers.

11.1 Fair Access

Members must not:

• Reserve sessions without a genuine intention to attend.
• Make speculative, duplicate or unnecessary bookings.
• Repeatedly reserve and cancel desirable time slots.
• Use multiple accounts to circumvent booking restrictions.
• Share membership privileges with unauthorised individuals.
• Remain in a simulator bay beyond their confirmed booking time without permission.
• Use membership access for unauthorised commercial purposes.

11.2 Unlimited Membership Access

Unlimited Memberships provide repeated eligible studio sessions during designated access hours without additional standard bay-hire charges.

Unlimited access does not provide exclusive or guaranteed use of facilities.

There is no fixed weekly attendance limit.

11.3 Booking Management

Unlimited Membership holders:

• May hold up to two active future bookings.
• May make one advance booking per day.
• May book additional same-day sessions where availability permits.
• Must comply with confirmed booking start and finish times.
• Must cancel bookings they no longer intend to attend.

11.4 Prohibited Commercial Use

Memberships must not be used for:

• Paid coaching without written authorisation.
• Commercial lessons or training.
• Reselling simulator time.
• Hosting paid events.
• Operating a business using the facilities.
• Other unauthorised commercial activities.

11.5 Monitoring and Enforcement

Fairway Legends Performance may review booking and attendance records to identify genuine misuse.

Frequent legitimate attendance alone will not constitute misuse.

Where misuse is identified, proportionate action may include:

1. A written warning.
2. Temporary restrictions on advance booking privileges.
3. Temporary suspension of relevant benefits.
4. Termination for serious or repeated breaches.

Members will normally be given an explanation and an opportunity to respond before restrictions or termination, except where immediate action is reasonably necessary for safety or to prevent serious misuse.

Any action taken will be reasonable, proportionate and consistent with applicable consumer law.

12. Unlimited Lite Membership (Studio)

12.1 Membership Fee

£150 per month.

12.2 Access Hours

Monday to Friday, 9:00 AM – 3:00 PM.

12.3 Included Benefits

Unlimited Lite includes:

• Unlimited eligible indoor golf sessions during designated access hours.
• Access to TrackMan simulator technology.
• Recreational golf practice and play.
• Advance booking privileges.
• Additional same-day sessions where availability permits.

12.4 Booking Conditions

All sessions must be booked through the official Fairway Legends Performance booking system.

Bookings are subject to availability, confirmed session times and the Membership Fair Use Policy.

There is no fixed weekly attendance limit or membership-wide two-hour session restriction.

Access outside designated membership hours is not included unless separately purchased or expressly authorised.

12.5 Guests

Members may bring up to three guests per booking, subject to capacity and applicable guest conditions.

The named member must remain present throughout the booking.

13. Unlimited Ultra Membership (Studio)

13.1 Membership Fee

The monthly fee is the price confirmed at the time of purchase.

13.2 Access Hours

9:00 AM – 10:00 PM, on the eligible days expressly stated in the membership offer and booking system.

13.3 Included Benefits

Unlimited Ultra includes:

• Unlimited eligible indoor golf sessions during designated access hours.
• Access to TrackMan simulator technology.
• Recreational golf practice and play.
• Advance booking privileges.
• Additional same-day sessions where availability permits.

13.4 Booking Conditions

All sessions must be booked through the official Fairway Legends Performance booking system.

Bookings are subject to availability, confirmed session times and the Membership Fair Use Policy.

There is no fixed weekly attendance limit or membership-wide two-hour session restriction.

Access outside designated membership hours is not included unless separately purchased or expressly authorised.

13.5 Guests

Members may bring up to three guests per booking, subject to capacity and applicable guest conditions.

The named member must remain present throughout the booking.

14. Par Studio Membership

14.1 Membership Allowance

The Par Studio Membership includes four (4) studio booking credits per month, with each credit representing one hour of eligible studio use.

14.2 Booking Access

Members may use their credits to book eligible studio sessions during the access hours advertised for the membership.

All bookings are subject to availability.

14.3 Credit Usage

• One credit represents one hour of eligible studio use.
• Credits are deducted according to the confirmed booking duration.
• Credits cannot be exchanged for cash or transferred to another member.
• Unused credits do not automatically carry forward unless expressly included in the membership offer.
• Any additional studio time beyond the included credits may be purchased at the applicable rate.

14.4 Guests

Members may bring up to three guests per booking, subject to capacity and applicable guest conditions.

The named member must remain present throughout the booking.

14.5 General Conditions

The Par Studio Membership is subject to the general Studio Membership Terms & Conditions, including the applicable minimum commitment, cancellation policy, payment requirements and booking rules.

15. Health & Safety

15.1. Members and guests must use facilities responsibly and follow reasonable safety instructions.

15.2. Golf equipment, simulators and putting facilities must only be used for their intended purpose.

15.3. Members must ensure children attending under their booking are appropriately supervised.

15.4. Members should take reasonable care of their personal belongings.

15.5. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be excluded.

15.6. Members’ statutory consumer rights remain unaffected.

16. Temporary Closures & Maintenance

16.1. Fairway Legends Performance may temporarily restrict access for essential maintenance, repairs, safety requirements or other reasonable operational needs.

16.2. Reasonable advance notice of planned closures will be provided wherever practicable.

16.3. Where a significant or prolonged closure materially reduces agreed membership benefits, appropriate extensions, credits, refunds or other remedies will be considered in accordance with applicable law.

17. Membership Suspension & Termination

17.1. Fairway Legends Performance may temporarily suspend membership privileges where there is a reasonable basis to believe a serious breach of these Terms has occurred.

17.2. Reasons may include:

• Serious or repeated booking misuse.
• Unauthorised commercial use.
• Threatening or abusive behaviour.
• Deliberate equipment damage.
• Serious safety violations.
• Continued non-payment.

17.3. Members will normally receive written notification explaining the reason for suspension or termination.

17.4. Members will normally have an opportunity to respond, except where immediate action is reasonably necessary.

17.5. Any fees, refunds or outstanding obligations arising from termination will be assessed fairly and in accordance with applicable law.

18. Changes to Membership Terms

18.1. Fairway Legends Performance may make reasonable changes to these Terms where necessary to comply with legal requirements, improve safety or address legitimate operational needs.

18.2. Members will receive reasonable advance notice of material changes.

18.3. Changes will not remove statutory rights or permit unfair reductions to contracted benefits.

18.4. Where a material change is detrimental to a member, applicable rights to reject the change or terminate the agreement will be respected.

Our Studio Memberships are designed to encourage regular practice, improvement and enjoyment while ensuring fair access to our premium facilities.

By respecting these Terms & Conditions, members help us maintain a welcoming environment and an exceptional golfing experience for the entire Fairway Legends Performance community.

This section applies to Fairway Legends Academy Memberships, including Junior Indoor, Men’s and Ladies academy memberships as advertised.

By purchasing an Academy Membership, you agree to the following Terms & Conditions. Where Academy sessions take place at the Hermitage Works studio, the studio conduct, equipment, health & safety and CCTV rules in Section C also apply.

B1. Membership Agreement

Your Academy Membership secures a place in the relevant weekly academy programme and any additional benefits included in your chosen tier, for as long as the membership remains active and payments are up to date.

Membership benefits are personal to the named member (or named junior participant) and cannot be transferred to another individual without our prior written agreement.

B2. Eligibility & juniors

Men’s and Ladies Academy Memberships are available to individuals aged 18 or over, unless we agree otherwise in writing.

Junior Academy Memberships must be purchased by a parent or legal guardian, who accepts these Terms & Conditions on behalf of the junior participant and remains responsible for the junior’s attendance, conduct and any associated fees.

You must provide accurate contact details and keep them up to date so we can communicate about sessions, venue changes and membership matters.

Parents/guardians are responsible for ensuring the Participant Information & Consent Form has been completed before a junior participant attends their first session and for notifying Fairway Legends promptly if any information changes.

B3. Membership Term

Academy Memberships operate on a 12-month rolling agreement unless a different term is expressly stated at the time of purchase.

Members commit to a minimum initial term of 12 months.

Following the initial 12 months, the membership will continue automatically until cancelled in accordance with these Terms & Conditions.

B4. Cooling-off period

If you purchase an Academy Membership online or by other distance means, you may have a 14-day cooling-off right under the Consumer Contracts Regulations. If you ask us to start providing membership benefits during that period and then cancel, you may be charged a reasonable amount for sessions or services already provided.

B5. Membership Cancellation

Academy Memberships may only be cancelled by providing a minimum of 3 months’ written notice by email to [email protected] (or another written method we expressly accept).

The notice period begins from the date Fairway Legends receives written confirmation of cancellation. Membership fees remain payable throughout the notice period.

Fairway Legends reserves the right to terminate any Academy Membership where these Terms & Conditions are repeatedly breached, or where behaviour is abusive, dangerous or disruptive.

B6. Membership Payments

Membership fees are collected monthly on the 1st day of each calendar month (or as otherwise stated at checkout).

Members (or the parent/guardian for Junior Academy) are responsible for ensuring a valid payment method is maintained at all times.

If a payment fails or is not received by the due date, Fairway Legends reserves the right to suspend academy place and related benefits until outstanding payments are received in full, and to cancel the membership if arrears remain unpaid. Outstanding fees, including any applicable notice period, remain payable.

B7. Academy sessions & venues

Academy Memberships secure a place in the weekly programme subject to capacity and coaching schedules. Session times and venues, including the Performance Studio at Hermitage Works, may change for operational, coaching or weather-related reasons. We will use reasonable efforts to notify members of material changes.

Missed academy sessions are not automatically refunded or credited unless we cancel the session and are unable to offer a reasonable alternative.

B8. Conduct

Members and junior participants (and accompanying adults) agree to treat coaches, staff, facilities and other participants with respect, follow coaching instructions, and wear appropriate footwear and clothing for the session venue.

Parents/guardians remain responsible for junior participants before and after sessions and must make suitable arrangements for drop-off and collection.

B9. Membership Benefits

Academy benefits apply only while membership payments remain up to date, cannot be exchanged for cash, cannot be transferred to another person, and may be amended where reasonably necessary.

B10. Health & Safety

Academy coaching involves physical activity. Participants should take reasonable care for their own safety and tell coaches about any relevant injury or medical condition that may affect safe participation.

Nothing in these Terms & Conditions excludes or limits Fairway Legends’ liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

B11. Participant Information & Safeguarding

Members, participants and parents/guardians are responsible for ensuring that all information provided in the Fairway Legends Participant Information & Consent Form remains accurate and up to date throughout the membership.

This includes, but is not limited to:

• Medical conditions
• Allergies
• Medication
• Emergency contact details
• Collection arrangements (where applicable)
• Any other information relevant to the participant’s safe participation

Fairway Legends reserves the right to refuse participation until the required safeguarding and emergency information has been provided or updated where reasonably necessary for the safety and wellbeing of participants.

B12. Changes

Fairway Legends reserves the right to amend these Academy Membership Terms where reasonably necessary to improve the operation of the academies or comply with legal requirements. Members will be notified of any significant changes.

This section applies to general studio hire and casual bookings at Fairway Legends Trackman Studio, Hermitage Works — including Bay Hire, ZEN putting green hire, Fun Hire / social sessions, lessons and other pay-as-you-go bookings made through our booking system (unless a separate written agreement applies). Additional terms for individual and group golf tuition are set out in Section D.

By completing a booking, you agree to these Terms & Conditions.

C1. Bookings

All studio hire is subject to availability and confirmation through the Trackman booking platform (or another booking method we provide).

The person named on the booking is responsible for the booking, payment, and the conduct of everyone attending under that booking.

Bookings are for personal / recreational use unless we have given prior written permission for commercial coaching or business activity.

C2. Payment

Studio hire fees are payable at the time of booking unless otherwise stated. Prices are as shown at checkout and include VAT where applicable.

Gift cards / vouchers may be used where accepted by the booking system and subject to their own terms.

C3. Changes & Cancellations

You may cancel or reschedule a booking more than 48 hours before the scheduled start time without penalty (subject to availability for any rebooking).

Bookings cancelled within 48 hours of the scheduled start time will be treated as used and cannot normally be refunded, credited or rebooked.

Failure to attend a booking without prior notice (“no-show”) will result in the booking being forfeited.

Fairway Legends reserves the right to exercise discretion in exceptional circumstances, and to cancel or amend bookings where reasonably necessary (for example for safety, equipment failure or operational reasons). Where we cancel a booking for reasons within our control, we will offer a rebooking or refund of the affected session fee.

C4. Arrival & use of facilities

Please arrive in good time for your booking. Sessions end at the booked finish time so the next customers can start promptly.

Hire is limited to the area and duration booked (bay, ZEN green or other facility as confirmed). Maximum occupancy must not exceed the capacity of the booked area or any limit stated at booking.

Under-18s must be supervised by a responsible adult for the duration of the booking, unless attending a supervised Fairway Legends coaching or academy session.

C5. Customer Responsibilities

All customers and guests agree to:

• Treat the facilities, equipment and staff with respect.
• Follow all instructions given by Fairway Legends staff.
• Ensure all golf clubs are clean before entering the simulator bays.
• Use only the golf balls supplied by Fairway Legends within the simulator bays.
• Wear appropriate footwear and clothing.
• Leave the studio and equipment in a clean and tidy condition after use.

C6. Damage to Equipment

Customers accept responsibility for any damage caused by themselves or their guests through negligence, misuse or failure to follow studio rules, including but not limited to simulator screens, TrackMan launch monitors, projectors, Zen Green putting equipment, furniture, fixtures, retail displays and any other Fairway Legends property.

Fairway Legends reserves the right to recover the full cost of repair or replacement where damage has occurred.

C7. Health & Safety

Indoor golf and use of studio facilities involve physical activity. Customers and guests should take reasonable care for their own safety and tell staff about any relevant injury or medical condition that may affect safe participation.

Subject to the paragraph below, customers and guests use the facilities at their own risk, and Fairway Legends is not responsible for injury, loss or damage resulting from failure to follow staff instructions, misuse of equipment, reckless or inappropriate behaviour, or personal belongings left unattended.

Nothing in these Terms & Conditions excludes or limits Fairway Legends’ liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

C8. CCTV and coaching recording

CCTV cameras operate at the Fairway Legends Trackman Studio for security, safety, crime prevention and incident investigation. By entering the studio, customers and guests acknowledge that they may be recorded. CCTV footage is retained by Fairway Legends for 6 months (or longer if needed for an incident or legal requirement). Coaching/TrackMan performance data sits with TrackMan and/or your coach, not Fairway Legends. Further detail is set out in our Privacy Policy.

C9. Fair use & refusal of service

Fairway Legends reserves the right to refuse entry, end a session early, or decline future bookings where there is evidence of abuse of the booking system, damage to property, or behaviour considered abusive, dangerous or disruptive towards staff, customers or guests.

C10. Changes

Fairway Legends reserves the right to amend these Studio Hire Terms where reasonably necessary to improve the operation of the business or comply with legal requirements. The version published on this website at the time of booking applies to that booking.

These terms apply to individual golf tuition, group coaching sessions and coaching packages that are not provided as part of an Academy Membership.

Where tuition takes place at the Hermitage Works studio, the studio conduct, equipment, health & safety and CCTV rules in Section C also apply.

D1. Bookings

Tuition sessions are subject to availability and confirmation.

D2. Cancellations

Lessons cancelled with more than 48 hours’ notice may be rescheduled.

Lessons cancelled within 48 hours are normally forfeited unless Fairway Legends agrees otherwise in exceptional circumstances.

D3. Participant Responsibilities

Participants must:

• Follow all reasonable instructions given by the coach.
• Inform Fairway Legends of any injury or medical condition that may affect participation.
• Wear appropriate clothing and footwear.

D4. Liability

Golf is a sporting activity involving inherent risks. Participants take part at their own risk except where liability cannot legally be excluded.

Nothing in these Terms excludes or limits Fairway Legends’ liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded.
